Is talc bad for your baby. But with 75% of talc plaintiffs, which is required for bankruptcy plan approval is a difficult road due to the sheer number of lawyers with vast collections of baby powder litigations opposed against the proposed settlement.
What could solve the impasse? More billions.
April 25 2023 Update Talc patients have demanded a judge reject their Chapter 11 case filed by LTL Management LLC, a absurdly made-up Johnson & Johnson subsidiary, insisting that the company is not financially strained. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Is talc bad for your baby. The 3rd Circuit dismissed its first Chapter 11 case in January, saying LTL was not a candidate for bankruptcy relief because it had not demonstrated financial stress.
The plaintiffs argue that LTL’s second Chapter 11 case is an abuse of the bankruptcy system and it’s being conducted in bad good faith. J&J asserts that the bankruptcy settlement is backed by “significant backing” from firms representing about 60,000 potential claimants. It’s safe to say that the plaintiffs’ attorneys and victims are divided over their disagreement over the $8.9 billion offer for settlement.
April 21, 2023 Update: A bankruptcy judge has ruled that Johnson & Johnson must face new lawsuits alleging that the firm sold a baby powder that contained a chemical that causes cancer. Judges expressed skepticism about J&J’s ridiculous effort to revive its strategy with the second bankruptcy case.
April 13, 2023 Update: biggest news is the $8.9 billion over 25 years offer for settlement. Lawyers representing cancer victims who are part of MDL class action MDL collective action pledged to challenge the settlement the talc claimants. Why? They feel it’s not enough money for 70 000 cancer patients. Is talc bad for your baby. They argue that J&J should negotiate a bigger settlement or pursue individual claims in the event that the latest bankruptcy is declared unconstitutional.
There is a different group of lawyers outside of the top leadership in that class action. These lawyers have amassed the equivalent of tens of thousands of lawsuits. This group wants to settle today with what they believe is far less than what these victims deserve. The argument they make is two-fold. First, they argue the settlement – about an average of $100,000 per plaintiff is fair.
It’s a difficult argument to present. The second argument is more substance: the victims will not afford to wait any longer and need their money now.
April 12 2023 Update: People are wondering if J&J can file for bankruptcy once more. The answer is complex and convoluted. Let’s try to clarify the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only method to deal with both present and future lawsuits involving talc conclusively. That is, it believes it can pay less in the event of an element of bankruptcy that puts pressure to negotiate a settlement. Is talc bad for your baby. In a quest to cover 400 years of American history, the company argues that bankruptcy benefits all parties as it distributes settlements more equally and effectively than trial courts in which some litigants receive substantial payouts, while others are left with nothing.
The gist in this 3rd Circuit decision was this is not a matter of a profitable company making a subsidiary to take the legal burden and declare bankruptcy – something Congress had in mind when it came to drafting the Bankruptcy Code. It also clarified that the subsidiary was not financially distress because J&J offered unlimited financing.
So J&J did not hesitate to take advantage of the unlimited funding aspect of the contract and didn’t make any promises to offer unlimited funding for litigation. The company says that its new financing agreements with its subsidiary will address appeals court’s concerns, while supplying funds for claim payments. As if offering victims lesser money could solve the underlying issue.
Attorneys representing cancer patients who do not agree with the agreement counter this argument by saying that it is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s previous decision. Hyperbole is not exempt the lawyers representing victims call it the largest “fraudulent transfer of assets in United States history.”
In spite of the legal jargon, J&J does not really think that the bankruptcy will endure. But it is a way to try and push the $8.9 billion settlement and keep pressure on plaintiffs.
April 10 2023 update: Bloomberg is running an intriguing piece on a law that has been passed of New Jersey that is shedding new light on litigation funding in the Class action suit. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) regarding talc products, in exchange for a share of any winnings. J&J is now offering an offer of $8.9 billion to settle any lawsuits.
The involvement of the funders is made public due to a New Jersey court rule requiring the disclosure of certain information regarding outside funding backers. The rule aims to address the growing calls for regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you add up federal and state Baby Powder lawsuits. Third-party financing in mass tort cases has its pros and pros and. However, there is no doubt that we are seeing how third-party funding could level the playing field between individual and big companies in the courtroom.
April 4, 2023 Update: It is pleasing to see the worm turning in this legal battle. J&J has taken another blow this week, when they were denied by the Third Circuit denied J&J’s request to keep the automatic stay in place during the time that J&J appeals an order granting bankruptcy before the U.S. Supreme Court. Automatic stays have halted hundreds of cases involving talcum powder and prevented the filing of new lawsuits ever since J&J initiated the controversial effort to spin talc-related liabilities into a bankrupt entity over one year ago. Is talc bad for your baby. After the 3rd Circuit ruled that this bankruptcy was not legal just a few months ago the stay was removed. J&J wanted to see it stayed in place until hearing the SCOTUS appeal. But, no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance is that the Supreme Court is willing even to accept the appeal? Low.

Seven new talc cases were joined to the MDL over the last month which brings the total number of pending cases up to 37,522.
February 25, 2023 Update This morning, a Congressmen from Tennessee has now demanded that the U.S. Government Accountability Office (GAO) launch an investigation into how much J&J products containing talc have cost the government in the many years.
A recent email addressed to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of ignoring the dangers of its talc-based products for years while tax dollars were utilized to treat people injured by exposure to the products. The demand comes just weeks after J&J’s loss to the 3rd Circuit Court of Appeals.
