Lawyers representing cancer patients who oppose the deal counter this by arguing that the plaintiff is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s ruling. Hyperbole was not spared: victims’ lawyers call this the biggest “fraudulent transfer that has occurred in United States history.”

In spite of the legal jargon, J&J does not really think that the bankruptcy will endure. It is however a method of pushing this $8.9 billion settlement, and to keep the pressure on plaintiffs.

The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of claims against Johnson & Johnson (J&J) concerning talc products in exchange for a share of any settlements.
