Johnson & Johnson (JNJ.N) has set aside $400 million to resolve U.S. state consumer protection actions as part of its broad $8.9 billion deal to settle allegations that its Baby Powder and other talc-based product causes cancer. No talc baby powder.
J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that outlines how the firm plans to pay different kinds of cancer victims as part of bankruptcy settlement. No talc baby powder. J&J has declared that its Talc products are safe, and won’t cause cancer. The company is trying for another time to settle more than 38,000 cases in bankruptcy, and to prevent any new cases from being filed in the future.
The bankruptcy plan of LTL would pay $400 million to an additional trust to settle lawsuits filed with state attorneys general alleging that J&J did not comply with state unfair business practices and consumer protection laws, by deceiving consumers regarding the safety of its talc products.
Several states had begun consumer protection cases against J&J before LTL’s first bankruptcy filing stopped those investigations from moving forward in 2021. No talc baby powder. “The filing is an unjust and legally flawed attempt by a handful of law firms to try to stop claimants from deciding on the resolution, which that the overwhelming majority of claimants are in favor of,” J&J’s litigation chief Erik Haas, said in an announcement. April 13 2023 update: the most important news is the $8.9 billion over the next 25 years offer for settlement. April 12 2023 Update: Many are wondering if J&J can file for bankruptcy again. The answer is complicated and confusing. But let’s try to explain the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only option to resolve both current and future talc litigations in a definitive manner. That is, it thinks it can get a lower rate should there be a bankruptcy component that applies pressure for a settlement. No talc baby powder. Moving past more than 400 years in American past, the company asserts that bankruptcy benefits everyone by dispersing settlement payments more evenly and effectively than trial courts, where litigants are awarded significant payouts, while others are left with nothing.
The gist in this 3rd Circuit decision was this is not a matter of a profitable company making a subsidiary to take the legal responsibility and declare bankruptcy Congress contemplated when drafting the Bankruptcy Code. Attorneys representing cancer patients who do not agree with the agreement counter this with what you conclude is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s previous decision. Hyperbole did not go unnoticed by the victims’ lawyers, who call it the most significant “fraudulent move of assets in United States history.”
Despite all the legal jargon, J&J does not really believe this bankruptcy will be able to last. But it is a way to push for this $8.9 billion settlement, and to keep the pressure on plaintiffs.
April 10, 2023 Update Bloomberg provides an insightful report on a brand new law within New Jersey that is shedding new light on litigation funding in the Class action suit. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) concerning talc products in exchange in exchange for a portion of winnings.
