Johnson & Johnson asserts that bankruptcy is the only means to settle both present and future talc-related lawsuits definitively. It believes it can pay less when there is a bankruptcy element that creates pressure to settle. The hyperbole wasn’t spared attorneys representing the victims claim it the largest “fraudulent move ever in United States history.”

Despite the legal jargon, J&J does not really believe this bankruptcy will be able to last. But it’s a way of pushing this $8.9 billion settlement and keep pressure on plaintiffs.
