Kaplan has instructed both sides to create a strategy for reorganization, under the supervision from two mediators.
In February 2022, Kaplan confirmed J&J’s use of Chapter 11 to hasten a settlement that will free J&J from the hundreds of thousands of claims related to its talcum-based products.
However, in the month of January, an appeals court in the United States overturned the ruling, ruling that the business could not be considered to be in “financial financial distress.”

Kathy worley cook Johnson and Johnson lawsuit. Randi Ellis, a lawyer who regularly appears in MDLs throughout the country was appointed as the claims representative in the previous bankruptcy. J&J’s defense team would like Ellis to be appointed to that role yet again, but the lawyers for the talc plaintiffs are protesting on the grounds that Ellis has a conflict of interest which should stop her from assuming that position again. Lawyers are divided over whether or not to accept the plan and not all clients see the issue in the same manner their lawyer sees it. The US Trustee also asked that it be requested that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice-president of litigation Erik Haas, was quoted by Bloomberg as saying that J&J intends to file a statement to the appeals court characterizing the filing as an “desperate and legally deficient plan” by a handful of law firms that have different financial interests.
May 1, 2023 Update: One frequently asked question is how the plaintiffs’ lawyers and their clients turn off $8.9 billion. That’s of course a lot of money. But there are a lot of victims. Kathy worley cook Johnson and Johnson lawsuit. These are actually a good case for plaintiffs. We were reminded of this recently by two talc-related trials that ended in large verdicts for plaintiffs. In February the mesothelioma case involving talcum powder trial in Oregon was settled with an award that was $18.1 million. In the same month, a different mesothelioma talc case was brought to trials within South Carolina and resulted in a verdict of $29million in favor of plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. one of the most prominent manufacturers of talc in U.S.
April 30th 2023 Update: In the year 2023, when J&J first tried to bring the talcum powder lawsuit into bankruptcy, it was met with an offer to put aside $2 billion for settlements. The sum was ridiculously low. There was no one among the talc victims who were in favor of the proposal. However, this time, J&J has increased the offer to $8.9 If the talc plaintiffs accept a bankruptcy settlement and also has the support of a large portion of the talc plaintiffs as well as their lawyers. Kathy worley cook Johnson and Johnson lawsuit. But with 75% of talc plaintiffs, which is required to approve bankruptcy plans is a difficult road because of the number of lawyers who have huge inventories of baby powder-related lawsuits, opposed to the settlement.
What can be done to end the impasse? More billions.
April 25, 2023 update: Talc cancer claimants have sought a court order to disqualify the Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, insisting that the company is not financially distressed. LTL has filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Kathy worley cook Johnson and Johnson lawsuit. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that the company was not eligible for bankruptcy relief as it failed to show financial trouble.
The claimants argue that LTL’s Second Chapter 11 case is an fraud on the bankruptcy system, and that the case is being handled in bad faith. J&J claims the bankruptcy settlement is backed by “significant support” from firms representing about 60,000 potential claimants. It is fair to say that plaintiffs’ lawyers and victims ‘ lawyers are not united over what they believe is an $8.9 billion offer for settlement.
April 21, 2023 Update: A bankruptcy judge ruled in favor of Johnson & Johnson must face new lawsuits alleging that the firm sold baby powder that was contaminated and causing cancer. Kathy worley cook Johnson and Johnson lawsuit. Judges expressed doubt about J&J’s absurd attempt to revive its strategy with a second bankruptcy case.
April 13 2023 Update: The biggest update is about the $8.9 billion over the next 25 years offer for settlement. Lawyers representing cancer patients in the MDL Class Action have promised to fight the settlement with the talc claimants. Why? They argue that it’s not enough money for 70 000 cancer patients. Kathy worley cook Johnson and Johnson lawsuit. These lawyers argue that J&J should seek a bigger settlement or settle individual claims if the most recent bankruptcy is thrown out.
There is a different group of lawyers that is not part of the leadership group in group action. These lawyers have amassed many thousands of cases. They want to settle now for what many argue is lower than what the victims should be paid. The argument they make is two-fold. First, they argue that the settlement of around the equivalent of $100,000 per plaintiff is fair.
That is a hard argument to argue. However, their second argument has more teeth: victims can not afford to wait any longer and need to get their money right now.
April 12 2023 Update: Some people are wondering if J&J can file for bankruptcy again. The answer is complex and complex. However, let’s attempt to explain the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only option to deal with both present and future talc-related lawsuits definitively. That is, it believes that it will be less expensive if there is a bankruptcy element that creates pressure to negotiate a settlement. Kathy worley cook Johnson and Johnson lawsuit. In a quest to cover the 400-year span of American time, the business asserts that bankruptcy benefits all parties by distributing settlement payments more evenly and efficiently than trial courts, where some litigants receive significant award while others do not.
The main thrust in the 3rd Circuit decision was this is not a case of a profitable company making an entity to assume the legal responsibility and declare bankruptcy – something Congress considered when it was drafting the Bankruptcy Code. However, it also stated the company was financially trouble because J&J offered unlimited financing.
So J&J decided to go with the funding unlimited part of the holding and did not promise to fund unlimited cases. The company claims that updated financing arrangements with its subsidiary address the appeals court’s concerns while still supplying funds for claim payments. As if offering victims lower amounts of money would resolve the underlying issue.
Attorneys representing cancer patients who oppose the agreement counter this argument by saying that it is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s earlier decision. Hyperbole did not go unnoticed by the victims’ lawyers, who call this the biggest “fraudulent move in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really believe this bankruptcy will be able to last. But it’s a way of pushing this $8.9 billion settlement and keep pressure on plaintiffs.
April 10, 2023, Update Bloomberg is running an intriguing piece on a law that has been passed within New Jersey that is shedding new light on the funding of litigation in the baby powder suit for class actions. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) concerning talc products in exchange for a share of any winnings. J&J has now offered the payment of $8.9 billion to settle any lawsuits.
The involvement of the funders is made public due to the New Jersey court rule requiring the release of certain details about funding sources outside of the. The rules aim to tackle the growing demands for regulation of litigation funders. J&J has more than 60,000 claims when you add up federal and state Baby Powder lawsuits. Third-party funding for mass tort lawsuits has both pros and cons. But there is no question that we are seeing the ways that third-party funding can even the playing field between people as well as large corporations in the courtroom.
April 4 2023 Update: It is interesting to watch the worm turning in this litigation. J&J took another hit this week, when it was found that the Third Circuit denied J&J’s request to keep the automatic stay in place as J&J appeals an appeal in the U.S. Supreme Court. Automatic stays have frozen the cases of talcum powder in a number of years and stopped any new lawsuits from getting filed ever since J&J started the controversial process to spin the talc liabilities into a bankrupt company over one year in the past. Kathy worley cook Johnson and Johnson lawsuit. When it was decided that the 3rd Circuit ruled that this bankruptcy was not legal only a few months back, the stay was lifted. J&J wanted to see it remain in effect until an appeal to the SCOTUS appeal. But the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The likelihood that of the Supreme Court is willing even to take up the appeal? Low.
March 16th 2023 Update: with the bankruptcy stay now officially lifted, the very first new cases have been filed and transferred into the talcum powder class action MDL in just over a year. Seven new talc lawsuits have been included in the MDL over the last month and brought the total number of cases that are pending to 37,522.
February 25 2023 Update: A Congressmen from Tennessee is now requesting that The U.S. Government Accountability Office (GAO) start an investigation to determine how much J&J product containing talc has cost the government in the years.
A recent email addressed to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of ignoring the risks of its talc product for decades while tax dollars were spent treating those injured by exposure to the chemicals. The lawsuit comes just a few weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.
Kathy worley cook Johnson and Johnson lawsuit. J&J must begin making fair settlement offers to victims to begin the process of putting all this behind it. This is a blemish on one of the world’s greatest businesses.
