Johnson & Johnson asserts that bankruptcy is the only way to address both present and future talc litigations in a definitive manner. In other words, it thinks it can get a lower rate in the event of the bankruptcy element which applies pressure to settle. Baby powder talc asbestos. Going back to 400 years of American history, the company argues that bankruptcy benefits all parties by distributing settlement payments more evenly and more efficiently than trial courts where some litigants receive significant settlements while others get nothing.

Lawyers representing cancer patients who oppose the agreement counter this argument by saying that it is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole is not exempt: victims’ lawyers call it the largest “fraudulent transfer that has occurred in United States history.”
In spite of the legal jargon, J&J does not really think this bankruptcy will survive. It is however a method of trying to push this $8.9 billion settlement to keep pressure on plaintiffs.
