Johnson & Johnson asserts that bankruptcy is the only means to deal with both present and future lawsuits involving talc conclusively. Despite the legal jargon, J&J does not really think this bankruptcy will survive. But it is a way to try and push the $8.9 billion settlement, and to keep pressure on plaintiffs.
