J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that details how the company will pay various types of cancer patients in an arrangement for bankruptcy. April 13, 2023 Update: major announcement is an $8.9 billion over the course of 25 years of settlement. Lawyers representing cancer victims within MDL class action MDL Class Action have pledged to challenge the settlement Talc claimants. Why? April 12 2023 Update: Some people are wondering if J&J is able to file for bankruptcy again. The answer is complex and convoluted. However, let’s attempt to explain the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only method to resolve both current and future talc litigations in a definitive manner. Also, it thinks it will pay less in the event of the bankruptcy element which applies pressure to settle. Does baby powder have talc in it. Moving past more than 400 years in American history, the company argues that bankruptcy benefits all parties as it distributes settlement payments more evenly and effectively than trial courts, which are where litigants get significant settlements while others get nothing.
The gist in the 3rd Circuit decision was this isn’t a case that involves the profit-making company that has an entity to assume the legal burden and declare bankruptcy – something Congress contemplated when drafting the Bankruptcy Code. However, the court also ruled the company was in financial crisis due to the fact that J&J promises unlimited funding.

The company claims that new financing agreements with its subsidiary addresses the appeals court’s concerns while still offering claim payment funds. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of claims against Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a share of any wins. J&J is now willing the payment of $8.9 billion to settle all lawsuits.
The funders’ involvement is made public because of the New Jersey court rule requiring the release of certain details about outside funding backers. The rules aim to tackle the growing demands for regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you add up federal and state Baby Powder lawsuits. Steven Cohen (D-Ten.) claimed that J&J of ignoring the risks of its talc product for years while tax dollars were used to treat those who were injured through exposure to the products.
