April 13, 2023: Update on the most important news is the $8.9 billion over 25 years settlement offer. Johnson & Johnson asserts that bankruptcy is the only way to resolve both current and future talc lawsuits conclusively. In other words, it believes it can pay less if there is an element of bankruptcy that puts pressure to negotiate a settlement. Going back to more than 400 years in American history, the company believes that bankruptcy is beneficial to everyone by dispersing settlements more fairly and effectively than trial courts in which some litigants receive substantial payouts, while others are left with nothing.

Hyperbole did not go unnoticed the lawyers representing victims call it the most significant “fraudulent transfer of assets in United States history.”

Despite all the legal jargon, J&J does not really think that the bankruptcy will endure. However, it’s a means of pushing this $8.9 billion settlement and keep pressure on plaintiffs.

April 10, 2023 Update: Bloomberg provides an insightful piece on a law that has been passed in New Jersey that is shedding new light on the funding of litigation in the baby powder plaintiffs in the class action. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of claims from Johnson & Johnson (J&J) over talc products in exchange for a portion of any profits. J&J is now offering that it will pay $8.9 billion to settle lawsuits.

The involvement of funders is publicly available because of an New Jersey court rule requiring the disclosure of certain information about funders outside the state. The rule aims to address the rising calls for regulation of the litigation funders.
