May 1 2023 Update: A question people keep asking is how plaintiffs and their attorneys turn off $8.9 billion. Of course, that is an enormous amount of money. There are a lot of victims. Himalaya baby powder has talc. And these are really good case for plaintiffs. We were reminded recently with two talc trials ended in large verdicts for plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon was settled with the verdict in the amount of $18.1 million. A month later, another mesothelioma talc case was brought to trials on the other side of South Carolina and resulted in a verdict of $29 million for the plaintiff. This time, J&J has increased the offer to $8.9 if the talc plaintiffs accept a bankruptcy settlement and they have the support of a substantial part of the talc-related plaintiffs and their lawyers. Himalaya baby powder has talc. What could solve the impasse? More billions.
April 25, 2023 update: Talc Cancer victims have demanded a judge dismiss the Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, declaring that the company isn’t financially distressed. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders cause cancer. Himalaya baby powder has talc. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company wasn’t eligible to receive bankruptcy relief because it did not show financial stress.
The plaintiffs argue that the Second Chapter 11 case is an misuse of the bankruptcy system and that the case is being handled in bad faith. J&J states that the bankruptcy settlement has “significant support” from companies representing around 60,000 claimants. It’s fair to say plaintiffs’ lawyers and victims ‘ lawyers are divided on their disagreement over the $8.9 billion offer for settlement.
April 21, 2023 Update: A bankruptcy judge ruled the company Johnson & Johnson must face new lawsuits claiming that the company sold tainted baby powder causing cancer. Although the trials for Talc lawsuits are suspended for at least 60 days, new lawsuits can be filed, and lawyers will begin preparing their cases. Himalaya baby powder has talc. Judges expressed skepticism about J&J’s pathetic attempt to relaunch its strategy in a second bankruptcy case.
April 13 2023 Update: most important story is that there’s an $8.9 billion over the next 25 years offer for settlement. Lawyers representing cancer victims within MDL class action MDL collective action promised to fight the settlement along with talc claimants. Why? They believe it’s not enough money for those suffering from cancer who are 70,000. Himalaya baby powder has talc. These lawyers argue that J&J could negotiate a greater settlement or settle individuals’ claims if the current bankruptcy is thrown out.
But there’s a separate lawyer group that isn’t part of the leadership group in group action. They have amassed the equivalent of tens of thousands of lawsuits. The group is seeking to settle with what they believe is less than the victims deserve. Their argument seems to be twofold. First, they argue that the settlement – about an average of $100,000 per plaintiff is fair.
This argument isn’t easy to make. However, their second argument has more force: the victims can now not wait and they want to get their money right now.
April 12, 2023 Update: People are seeking out how J&J could file for bankruptcy again. The answer is complicated and convoluted. However, let’s attempt to explain the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only means to settle both present and future lawsuits involving talc conclusively. Also, it thinks it can get a lower rate should there be the bankruptcy element which applies pressure for a settlement. Himalaya baby powder has talc. Going back to hundreds of years of American history, the firm argues that bankruptcy benefits all parties because it distributes settlements more fairly and efficiently than trial courts, which are where litigants get significant settlements while others get nothing.
The essence in this 3rd Circuit decision was this is not a case of the profit-making company that has a subsidiary to take the legal responsibility and declare bankruptcy – something Congress had in mind when it came to drafting the Bankruptcy Code. However, the court also ruled the company was in financial distress due to the fact that J&J offered unlimited financing.
Then J&J jumped on the unlimited funding portion of the contract and did not promise that it would provide unlimited funds for the litigation. J&J claims that its revised financing arrangements with its subsidiary address appeals court’s concerns, while supplying funds for claim payments. As if offering victims lesser money could solve the overall issue.
Attorneys representing cancer victims who do not agree with the agreement counter this argument by saying that it is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole was not spared: victims’ lawyers call it the biggest “fraudulent transfer of assets in United States history.”
In spite of the legal jargon, J&J does not really think that the bankruptcy will endure. But it is a way to try and push the $8.9 billion settlement through and maintain pressure on plaintiffs.
April 10 2023 update: Bloomberg offers an informative report on a brand new law that has been passed in New Jersey that is shedding new light on the funding of litigation in the plaintiffs in the class action. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) regarding talc products, in exchange in exchange for a portion of winnings. J&J has now offered the payment of $8.9 billion to settle all lawsuits.
The involvement of the funders is publicly available because of an New Jersey court rule requiring the disclosure of certain information about outside funding backers. The rule aims to address the rising calls for the regulation of litigation funders. J&J faces over 60,000 claims when you take into account state and federal baby powder lawsuits. Third-party funding of mass tort cases is not without its pros and pros and. There is no doubt that we are seeing how third-party financing can help level the playing field between individuals and big corporations in court.
April 4 2023 Update: It’s enjoyable to see the worm turning in this legal battle. J&J took another hit this week, when it was found that the Third Circuit denied J&J’s request to maintain the automatic stay while J&J appeals a bankruptcy decision in the U.S. Supreme Court. This automatic stay frozen thousands of talcum cases and stopped the filing of new lawsuits ever since J&J launched the controversial attempt to spin the talc liabilities into a bankrupt company over a year back. Himalaya baby powder has talc. When it was decided that the 3rd Circuit ruled that this bankruptcy was not legal just a few months ago the stay was removed. J&J wanted to see it remain in effect until its SCOTUS appeal. But the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The likelihood that for the Supreme Court is willing even to accept the appeal? Low.

Seven new talc lawsuits were included in the MDL over the last month which brings the total number of cases that are pending to 37,522.
February 25, 2023 Update This morning, a Congressmen from Tennessee is now calling for The U.S. Government Accountability Office (GAO) begin an investigation into the amount J&J Talc products have cost the government in the many years.
in a letter to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of not recognizing the risks of its talc-based products for many years, while tax dollars were spent on treating people who suffered injuries from exposure to the products. This lawsuit comes a few weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.
Himalaya baby powder has talc. J&J should begin to make reasonable settlement offers to victims to to put all of this behind. This is a blemish on one of the world’s greatest businesses.
