Johnson & Johnson asserts that bankruptcy is the only option to settle both present and future talc-related lawsuits definitively. It believes it can pay less should there be an element of bankruptcy that puts pressure to settle. Is Johnson and Johnson talc safe. Moving past 400 years of American past, the company asserts that bankruptcy benefits all parties as it distributes settlements more equally and efficiently than trial courts, where litigants are awarded significant awards while others receive nothing.
The essence of this 3rd Circuit decision was this isn’t a case that involves a profitable company making an affiliate to accept the legal responsibility and declare bankruptcy – Congress considered when it was drafting the Bankruptcy Code. However, it also stated that the entity was financially trouble because J&J promised unlimited funding.
This is why J&J decided to go with the unlimited funding part of the holding and didn’t make any promises to fund unlimited cases. J&J claims that its updated financing arrangements with its subsidiary addresses the appeals court’s concerns while still supplying funds for claim payments. It’s as if giving victims less money will solve the overarching problem.
Lawyers representing cancer patients who do not agree with the agreement counter this with what you conclude is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s decision. The hyperbole wasn’t spared: victims’ lawyers call it the biggest “fraudulent transfer in United States history.”

J&J is now offering to pay $8.9 billion to settle any lawsuits.
The involvement of the funders is publicly available because of the New Jersey court rule requiring the disclosure of certain information about outside funding backers. The law is designed to tackle the growing demands for the regulation of lawsuit funders. J&J faces over 60,000 claims when you combine state and federal infant powder litigation. Third-party funding for mass tort lawsuits has pros and cons. But there is no question that we are seeing how third-party funding can level the playing field for individuals as well as large corporations in court.
April 4, 2023 Update: It is enjoyable to see the worm turning in this lawsuit. J&J was hit again this week, when it was found that the Third Circuit denied J&J’s request to maintain the automatic stay during the time that J&J appeals an appeal before the U.S. Supreme Court. Seven new talc-related lawsuits were joined to the MDL over the last month and brought the total number of cases in the pending process up to 37,522.
February 25, 2023 Update 2023 Update: A Congressmen from Tennessee is now demanding that authorities from the U.S. Government Accountability Office (GAO) start an investigation into how much J&J talc products have cost the government over the many years.
in a letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of ignoring the dangers of its talc-based products for many years, while tax dollars were used to treat those who were injured through exposure to the chemicals. The suit comes just a few days after J&J’s significant loss in the 3rd Circuit Court of Appeals.
