Johnson & Johnson (JNJ.N) has put aside $400 million to address U.S. state consumer protection actions as part of a larger $8.9 billion settlement of allegations that its Baby Powder and other talc items cause cancer. Is talc bad for dogs.
J&J company subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that outlines how the firm intends to pay for different types of cancer sufferers in bankruptcy settlement. April 12 2023 Update: People are wondering if J&J can go through bankruptcy again. The answer is complex and convoluted. But let’s try to explain it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only method to settle both present and future talc lawsuits conclusively. That is, it thinks it will pay less in the event of a bankruptcy component that applies pressure for a settlement. Is talc bad for dogs. Driving past the 400-year span of American time, the business claims that bankruptcy benefits all parties by distributing settlement payments more evenly and effectively than trial courts in which some litigants receive substantial award while others do not.

Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits against Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a share of any winnings. J&J has now offered that it will pay $8.9 billion to settle all lawsuits.
The involvement of the funders is publicly available due to an New Jersey court rule requiring the release of certain details about funding sources outside of the. The law is designed to tackle the growing demands for the regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you include federal and state infant powder litigation. Third-party funding of mass tort cases has its pros and pros and. February 25 2023 Update This morning, a Congressmen from Tennessee is now demanding that the U.S. Government Accountability Office (GAO) begin an investigation to determine how much J&J products containing talc have cost the government in the many years.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of not recognizing the risks of its talc-based products for long while tax dollars spent on treating people who suffered injuries from exposure to the chemicals. The suit comes just a few days after J&J’s major loss in the 3rd Circuit Court of Appeals.
