April 13th 2023 Update: The biggest announcement is an $8.9 billion over the course of 25 years settlement offer. Johnson & Johnson asserts that bankruptcy is the only way to resolve both current and future lawsuits involving talc conclusively. In other words, it thinks it will pay less if there is the bankruptcy element which applies pressure to settle. Is talc-free baby powder safe. In a quest to cover more than 400 years in American history, the firm believes that bankruptcy is beneficial to all parties as it distributes settlement payments more equitably and effectively than trial courts in which some litigants receive substantial award while others do not.
The essence of this 3rd Circuit decision was this is not a case of an enterprise that is profitable, forming subsidiaries to meet the legal risk and declare bankruptcy – Congress considered when it was drafting the Bankruptcy Code. The company claims that its updated financing arrangements with its subsidiary address the concerns of the appellate court, while offering funds to pay claims. In the hope that offering victims lower amounts of money would resolve the problem at hand.
Lawyers representing cancer patients who oppose the deal counter the agreement with what is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s decision. Hyperbole was not spared by the victims’ lawyers, who call it the biggest “fraudulent move ever in United States history.”
In spite of the legal jargon, J&J does not really believe this bankruptcy will be able to last. It is however a method to try and push the $8.9 billion settlement, and to keep pressure on plaintiffs.
April 10, 2023 update: Bloomberg is running an intriguing piece on a law that has been passed of New Jersey that is shedding new light on the funding of litigation in the baby powder suit for class actions. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits against Johnson & Johnson (J&J) regarding talc products, in exchange for a percentage of any winnings. The involvement of the funders is public information due to an New Jersey court rule requiring the disclosure of certain information regarding outside funding backers. February 25 2023 Update The following information is available: A Congressmen from Tennessee is now demanding that authorities from the U.S. Government Accountability Office (GAO) launch an investigation into how much J&J products containing talc have cost the government in the years.
A recent email to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of not recognizing the risks of its talc products over many years, while tax dollars were spent treating those injured by exposure to the chemicals.
