Johnson & Johnson asserts that bankruptcy is the only way to resolve both current and future lawsuits involving talc conclusively. In other words, it thinks it will pay less if there is the bankruptcy element which applies pressure to settle. Hyperbole was not spared by the victims’ lawyers, who call it the biggest “fraudulent move ever in United States history.”
