The committee believes that the recent ruling allowing LTL’s third Chapter 11 to continue, while also halting trials against J&J, warrants the immediate Third Circuit review. The US Trustee also requested that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation, Erik Haas, was quoted by Bloomberg as saying that J&J plans to file a response in the appeals court calling the request a “desperate and legally inadequate effort” by a few of law firms who have conflicting financial interests.
May 1st 2023 Update: A frequently asked question is how plaintiffs and their attorneys turn down $8.9 billion. Of course, that is an enormous amount of money. However, there are lots of victims. Is talc in vitamins bad for you. And these are really good claims for plaintiffs. We were reminded recently by two talc-related trials that led to huge verdicts for plaintiffs. In February mesothelioma, a talcum-based powder trial in Oregon led to an award in the amount of $18.1 million. A month later, another mesothelioma talc case was brought to trials within South Carolina and resulted in a verdict of $29million on behalf of the plaintiff. This was an absurdly low amount. The talc plaintiffs had not supported the offer. However, this time, J&J has increased the offer to $8.9 for talc-related plaintiffs if they agree to a bankruptcy settlement and also has the backing of a significant segment of the talc plaintiffs and their attorneys. Is talc in vitamins bad for you. However, 75% of plaintiffs who are a talc, which is required to approve bankruptcy plans is not an easy task with so many lawyers with vast collections of baby powder litigations opposed to the settlement.
What could solve the impasse? More billions.
April 25 2023 Update Talc Cancer victims have requested a judge to reject the Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, saying the company is not financially distressed. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby powders cause cancer. Is talc in vitamins bad for you. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January and said that LTL was not eligible for bankruptcy relief since it was unable to demonstrate financial distress.
The claimants contend that LTL’s 2nd Chapter 11 case is an misuse of the bankruptcy system and that the case is being handled in bad good faith. J&J says the bankruptcy settlement receives “significant backing” from companies representing around 60,000 claimants. It is fair to say that lawyers representing plaintiffs and victims are divided over what they believe is an $8.9 billion deal.
April 21st, 2023 Update A bankruptcy judge decided in favor of Johnson & Johnson must face new lawsuits alleging that the firm sold a baby powder that contained a chemical that causes cancer. While trials in talc lawsuits are paused for a minimum of 60 days but new lawsuits can be filed and lawyers can begin preparing their cases. Is talc in vitamins bad for you. The judge expressed his doubts about J&J’s pathetic attempt to revive its strategy with a second bankruptcy trial.
April 13 2023 Update: The major news is the $8.9 billion over 25 years of settlement. Lawyers representing cancer patients involved in MDL class action MDL collective action promised to challenge the settlement those who claim talc. Why? They feel it’s not enough for 70 000 cancer patients. Is talc in vitamins bad for you. These lawyers believe that J&J should seek a bigger settlement or even litigate individuals’ claims if the current bankruptcy is thrown out.
But there is another lawyer group that isn’t part of the leadership in group action. The lawyers collectively have accumulated hundreds of thousands of cases. The group is seeking to settle now with what they believe is lower than what the victims should be paid. Their argument appears to be twofold. They argue that the settlement, which is about the equivalent of $100,000 per plaintiff is fair.
That is a hard argument to make. However, their second argument has more teeth: victims can be no longer patient and demand their money now.
April 12 2023 Update: Many are wondering if J&J can file for bankruptcy once more. The answer is complicated and complex. But let’s try to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only option to deal with both present and future talc lawsuits conclusively. Also, it thinks it can get a lower rate when there is a bankruptcy component that applies pressure to negotiate a settlement. Is talc in vitamins bad for you. Going back to the 400-year span of American history, the company believes that bankruptcy is beneficial to all parties because it distributes settlement payments more evenly and effectively than trial courts, where some litigants receive significant settlements while others get nothing.
The main thrust of this 3rd Circuit decision was this is not a case of a profitable company making subsidiaries to meet the legal burden and declare bankruptcy – something Congress thought of when drafting its Bankruptcy Code. However, it also stated that the entity was financially distress due to the fact that J&J promised unlimited funding.
Then J&J took advantage of the funding unlimited part of the contract and didn’t make any promises that it would provide unlimited funds for lawsuits. J&J claims that its modified financing arrangements with its subsidiary addresses the concerns of the appellate court, while offering claim payment funds. In the hope that offering victims lesser money could solve the problem at hand.
Attorneys representing cancer patients who do not agree with the agreement counter this with what you conclude is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole was not spared by the victims’ lawyers, who call it the most significant “fraudulent transaction that has occurred in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think that the bankruptcy will endure. But it is a way to push for this $8.9 billion settlement, and to keep the pressure on plaintiffs.
April 10 2023 Update Bloomberg has an interesting article on a new law in New Jersey that is shedding new light on the funding of litigation in the baby powder Class action suit. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims against Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a share of any winnings. J&J is now willing to pay $8.9 billion in settlements for all lawsuits.
The involvement of the funders is made public due to an New Jersey court rule requiring the release of certain details about funders outside the state. The rules aim to address the rising calls for regulation of litigation funders. J&J is facing more than 60,000 claims when you combine federal and state baby powder lawsuits. Third-party funding of mass tort cases has both pros and cons. However, there is no doubt that we are seeing how third-party financing can help level the playing field between individual and big corporations in the courtroom.
April 4, 2023 Update: It is pleasing to see the worm turn in this case. J&J was hit again this week, when they were denied by the Third Circuit denied J&J’s request to keep the automatic stay in place while J&J appeals a bankruptcy decision in the U.S. Supreme Court. This automatic stay frozen the cases of talcum powder in a number of years and stopped new lawsuits from getting filed ever since J&J launched the controversial attempt to spin the talc liabilities into a bankrupt company over a year ago. Is talc in vitamins bad for you. After the 3rd Circuit ruled that this bankruptcy was insufficient only a few months back, the stay was revoked. J&J wanted to see it continue in the meantime of an appeal to the SCOTUS appeal. The answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that the Supreme Court is willing even to accept the appeal? Low.
March 16, 2023 Update: with the bankruptcy stay fully lifted, the first new cases were filed and incorporated into the class action involving talcum powder MDL within a year. Seven new talc lawsuits were joined to the MDL over the last month increasing the number of cases pending to 37,522.
February 25, 2023 Update This morning, a Congressmen from Tennessee is now calling for authorities from the U.S. Government Accountability Office (GAO) start an investigation into the cost J&J product containing talc has cost the government over the years.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of ignoring the dangers of its talc products for many years, while tax dollars were utilized to treat people injured by exposure to the chemicals. The suit comes just a few days after J&J’s significant loss in the 3rd Circuit Court of Appeals.
Is talc in vitamins bad for you. J&J should begin to make fair settlement offers to victims to in putting this behind. This is a blemish on one of the top businesses.
