LTL has filed for Chapter 11 protection once again following the bankruptcy filing it made earlier was rejected by the Third Circuit earlier this year which offered a $8.9 billion payment. The committee argues that the recent ruling allowing LTL’s second Chapter 11 to continue, while also halting trials against J&J is a reason for the immediate Third Circuit review. The US Trustee requested it be requested that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation, Erik Haas, was quoted by Bloomberg declaring that J&J plans to file a statement in the appeals court, declaring the filing an “desperate and legally inadequate plan” by a handful of law firms that have competing financial interests.
May 1 2023 Update: A frequently asked question is how could the plaintiffs’ lawyers and their clients turn down $8.9 billion. That’s of course a lot of money. There are a lot of victims. Is talc safe for face. These are actually a good case for plaintiffs. We have been reminded of this recently by two talc-related trials that led to huge verdicts for the plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon led to the verdict in the amount of $18.1 million. This time around, however, J&J has increased the offer to $8.9 in the event that the talc victims agree to a bankruptcy settlement and they also have the support of a substantial part of the talc-related plaintiffs and their lawyers. Is talc safe for face. However, 75% of talc plaintiffs, which is required for bankruptcy plan approval is not an easy task with so many lawyers with massive inventory of baby powder lawsuits that are opposed to the settlement.
What is the solution to this impasse? More billions.
April 25 2023 Update: Talc Cancer victims have sought a court order to reject the Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, declaring that the company isn’t financially strained. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Is talc safe for face. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January, saying LTL was not eligible for bankruptcy relief because it failed to show financial distress.
The claimants argue that LTL’s 2nd Chapter 11 case is an fraud on the bankruptcy system and it’s being pursued in bad good faith. J&J states that the bankruptcy settlement is backed by “significant support” from firms representing around 60,000 plaintiffs. April 13 2023: Update on the major news is the $8.9 billion over 25 years settlement offer. Lawyers representing cancer patients within MDL class action MDL group action pledged to fight the settlement alongside talc claimants. Why? They think it is not enough money for 70,000 victims who have cancer. Is talc safe for face. These lawyers believe that J&J should seek a bigger settlement or settle individuals’ claims if the current bankruptcy is dismissed.
But there’s a separate group of lawyers that is not part of the leadership group in group action. These lawyers have amassed the equivalent of tens of thousands of lawsuits. The group is seeking to settle the case now with what they believe is lower than what the victims should be paid. The argument they make is twofold. The first is that they claim the settlement of around an average of $100,000 per plaintiff is fair.
That is a hard argument to present. But their second argument has more force: the victims can now not wait and they want their money now.
April 12 2023 Update: People are looking for ways J&J could file for bankruptcy again. The answer is complex and complicated. Let’s try to clarify the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only option to resolve both current and future lawsuits involving talc conclusively. In other words, it thinks it will pay less in the event of the bankruptcy element which applies pressure to settle. Is talc safe for face. Moving past 400 years of American history, the firm claims that bankruptcy benefits all parties as it distributes settlements more equally and more efficiently than trial courts in which some litigants receive substantial awards while others receive nothing.
The essence of the 3rd Circuit decision was this is not a case – one that makes a profit, but a subsidiary to take the legal burden and declare bankruptcy, which is what Congress had in mind when it came to drafting the Bankruptcy Code. However, it also stated the company was in financial difficulty because J&J assured it of unlimited funding.
This is why J&J decided to go with the unlimited funding part of the contract but did not pledge to provide unlimited funding for lawsuits. J&J claims that its new financing agreements with its subsidiary addresses the appeals court’s concerns while still offering claim payment funds. In the hope that offering victims lower amounts of money would resolve the problem at hand.
Attorneys representing cancer victims who do not agree with the agreement counter this by arguing that the plaintiff is the legal argument. Is talc safe for face. They counter with legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s decision. The hyperbole wasn’t spared the lawyers representing victims call it the largest “fraudulent transaction in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really believe this bankruptcy will be able to last. However, it’s a means to push for this $8.9 billion settlement to keep the pressure on plaintiffs.
April 10 2023, Update Bloomberg provides an insightful report on a brand new law within New Jersey that is shedding new light on litigation funding in the baby powder suit for class actions. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) on behalf of talc products. They exchanged in exchange for a portion of winnings. J&J is now willing that it will pay $8.9 billion in settlements for all lawsuits.
The involvement of the funders is publicly available due to a New Jersey court rule requiring the release of certain details about funding sources outside of the. The law is designed to respond to the increasing calls for the regulation of lawsuit funders. J&J is facing more than 60,000 claims when you include federal and state baby powder lawsuits. Third-party funding for mass tort lawsuits has its pros and pros and. There is no doubt that we are seeing the ways that third-party funding can even the playing field between people and big corporations in the courtroom.
April 4, 2023 Update: It’s interesting to watch the worm turn in this lawsuit. J&J took another hit this week when it was found that the Third Circuit denied J&J’s request to extend the automatic stay during the time that J&J appeals a bankruptcy decision at the U.S. Supreme Court. Automatic stays have halted hundreds of cases involving talcum powder and stopped any the filing of new lawsuits ever since J&J launched the controversial attempt to spin the talc liabilities into a bankrupt company over one year ago. Is talc safe for face. When the 3rd Circuit ruled that this bankruptcy was invalid just a few months ago the stay was lifted. J&J had hoped to have it continue in the meantime of the SCOTUS appeal. The answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance the Supreme Court is willing even to take up the appeal? Low.

February 25, 2023 Update This morning, a Congressmen from Tennessee is now demanding that be the U.S. Government Accountability Office (GAO) start an investigation to determine how much J&J product containing talc has cost the government in the years.

J&J of ignoring the dangers of its talc product for many years, while tax dollars were utilized to treat people injured by exposure to the product. The demand comes just weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.
