J&J’s worldwide vice president of litigation, Erik Haas, was quoted by Bloomberg declaring that J&J intends to file a reply to the appeals court saying that the filing is a “desperate and legally inadequate plan” by a small number of law firms who have conflicts of financial interests.
May 1 2023 Update: One question people keep asking is how could plaintiffs and their lawyers be able to turn off $8.9 billion. That’s of course quite a sum. However, there are lots of victims. Talc contain asbestos. These are actually a good case for plaintiffs. We were reminded of this recently in two talc trials which resulted in big verdicts for plaintiffs. In February mesothelioma, a talcum-based powder trial in Oregon ended in the verdict in the amount of $18.1 million. The following month, a second mesothelioma trial involving talc was held for trial on the other side of South Carolina and resulted in the verdict of $29 million to the plaintiff. April 30 2023 Update: When J&J first tried to bring the talcum powder litigation into bankruptcy, it came with an offer to put aside $2 billion to settle the case. This was an absurdly low amount. Talc contain asbestos. But with 75% of plaintiffs in the talc category, which is necessary for bankruptcy plan approval is a difficult road because of the number of lawyers who have massive stocks of baby powder litigations opposed to the settlement.
What could solve the impasse? More billions.
April 25 2023, Update Talc cancer claimants have demanded a judge reject the Chapter 11 case filed by LTL Management LLC, a absurdly made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially troubled. LTL has filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders caused cancer. Talc contain asbestos. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January, saying the company was not eligible for bankruptcy relief since it did not show financial trouble.
The plaintiffs argue that LTL’s second Chapter 11 case is an misuse of the bankruptcy system and that the case is being handled in bad good faith. J&J claims the bankruptcy settlement is backed by “significant backing” from companies representing an estimated 60,000 plaintiffs. It’s fair to say that lawyers representing plaintiffs and victims ‘ lawyers are not united over what they believe is an $8.9 billion amount of settlement offered.
April 21, 2023 Update: A bankruptcy judge ruled the company Johnson & Johnson must face new lawsuits alleging that it sold tainted baby powder causing cancer. April 13th, 2023 Update: most important story is that there’s an $8.9 billion over the course of 25 year period settlement offered. Lawyers representing cancer victims in the MDL collective action promised to fight the settlement alongside those who claim talc. Why? They believe it’s too little money for the 70,000 victims who have cancer. Talc contain asbestos. These lawyers believe that J&J should negotiate a bigger settlement or even litigate individual claims if the latest bankruptcy is thrown out.
But there is another lawyer group that isn’t part of the leadership in group action. These lawyers have collectively amassed the equivalent of tens of thousands of lawsuits. The group is seeking to settle the case now with what they believe is lower than what the victims should be paid. Their argument seems to be twofold. First, they argue that the settlement, which is about the equivalent of $100,000 per plaintiff – is fair.
That is a hard argument to argue. But their second argument has more force: the victims can not afford to wait any longer and need the money immediately.
April 12, 2023 Update: People are wondering if J&J can go through bankruptcy once more. The answer is complex and complicated. But let’s try to explain it clearly.
Johnson & Johnson asserts that bankruptcy is the only option to deal with both present and future talc lawsuits conclusively. Also, it thinks it can get a lower rate in the event of the bankruptcy element which applies pressure to settle. Talc contain asbestos. Going back to more than 400 years in American history, the firm claims that bankruptcy benefits everyone by dispersing settlement payments more evenly and more efficiently than trial courts where litigants are awarded significant payouts, while others are left with nothing.
The essence in this 3rd Circuit decision was this isn’t a case that involves an enterprise that is profitable, forming an entity to assume the legal liability and declare bankruptcy – something Congress contemplated when drafting the Bankruptcy Code. However, the court also ruled that the subsidiary was not financially trouble because J&J promises unlimited funding.
So J&J took advantage of the funding unlimited part of the holding but did not pledge to offer unlimited funding for litigation. J&J claims that its modified financing arrangements with its subsidiary will address concerns of the appellate court, while providing funds for claims. In the hope that offering victims less money will solve the overarching problem.
Lawyers representing cancer patients who are against the agreement argue this with what you conclude is the legal argument. Talc contain asbestos. They counter with legal absurdity: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s ruling. Hyperbole did not go unnoticed the lawyers representing victims call it the most significant “fraudulent transaction of assets in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think that the bankruptcy will endure. But it’s a way to try and push the $8.9 billion settlement to keep the pressure on plaintiffs.
April 10, 2023 Update: Bloomberg is running an intriguing piece on a law that has been passed within New Jersey that is shedding new light on the funding of litigation in the baby powder class action lawsuit. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits that were brought against Johnson & Johnson (J&J) on behalf of talc products. They exchanged in exchange for a portion of winnings. J&J is now willing to pay $8.9 billion to settle lawsuits.
The funders’ involvement is public knowledge because of the New Jersey court rule requiring the disclosure of certain information about outside funding backers. The law is designed to respond to the increasing calls for the regulation of lawsuit funders. J&J has more than 60,000 claims when you include state and federal child powder-related lawsuits. Third-party financing in mass tort cases has its pros and pros and. However, there is no doubt that we are seeing how third-party funding could level the playing field between people and big companies in court.
April 4, 2023 Update: It’s fun to watch the worm turn in this legal battle. J&J took another hit this week when it was found that the Third Circuit denied J&J’s request to extend the automatic stay while J&J appeals an appeal before the U.S. Supreme Court. The automatic stay has froze thousands of talcum cases and stopped new lawsuits from arising ever since J&J launched the controversial attempt to spin the talc debts into a bankrupt subsidiary more than one year in the past. Talc contain asbestos. When it was decided that the 3rd Circuit ruled that this bankruptcy was not valid some months ago, the stay was revoked. J&J was hoping to have it continue in the meantime of its SCOTUS appeal. But the answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The likelihood that the Supreme Court is willing even to accept the appeal? Low.
March 16, 2023 Update: with the bankruptcy stay fully lifted, the first new cases have been filed and transferred into the Talcum Powder class action MDL in over one year. Seven new talc lawsuits were included in the MDL during the month of March, bringing the total number of pending cases up to 37,522.
February 25, 2023 Update This morning, a Congressmen from Tennessee has now demanded that the U.S. Government Accountability Office (GAO) start an investigation to determine how much J&J talc products have cost the government over the many years.
in a letter to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of ignoring the dangers of its talc product for decades while tax dollars were spent treating those injured by exposure to the product. The lawsuit comes just a few weeks after J&J’s major loss in the 3rd Circuit Court of Appeals.
Talc contain asbestos. J&J needs to start making reasonable settlement proposals to victims to begin getting this behind it. This is a blemish on one of the world’s greatest firms.
February 14 2023 Update: At a hearing today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the third U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
