In a quest to cover 400 years of American time, the business claims that bankruptcy benefits all parties by distributing settlements more fairly and efficiently than trial courts, which are where litigants get significant awards while others receive nothing.

Despite all the legal jargon, J&J does not really believe this bankruptcy will be able to last. However, it’s a means to push for this $8.9 billion settlement, and to keep the pressure on plaintiffs.
April 10 2023, Update Bloomberg has an interesting piece on a law that has been passed of New Jersey that is shedding new light on the funding of litigation in the class action lawsuit. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of claims from Johnson & Johnson (J&J) regarding talc products, in exchange in exchange for a portion of settlements. J&J has now offered an offer of $8.9 billion to settle all lawsuits.
The involvement of funders is public information because of a New Jersey court rule requiring the disclosure of certain information about outside funding backers. The law is designed to address the growing calls for regulation of the litigation funders. J&J has more than 60,000 claims when you combine state and federal child powder-related lawsuits.
