J&J affiliate LTL Management filed a bankruptcy plan in New Jersey late on Monday which outlines how the company intends to pay different types of cancer victims in the bankruptcy settlement. Johnson & Johnson asserts that bankruptcy is the only option to resolve both current and future talc litigations in a definitive manner. It thinks it can get a lower rate in the event of a bankruptcy element that creates pressure to negotiate a settlement. Will talc cause cancer. Hyperbole was not spared: victims’ lawyers call it the most significant “fraudulent transaction that has occurred in United States history.”
Despite the legal jargon, J&J does not really think this bankruptcy will survive. But it is a way of trying to push this $8.9 billion settlement to keep the pressure on plaintiffs.
