Johnson & Johnson (JNJ.N) has set the amount of $400 million for resolving U.S. state consumer protection actions as part of a broad $8.9 billion plan to settle claims that its Baby Powder and other talc-based products cause cancer. Will talc cause cancer.

J&J affiliate LTL Management filed a bankruptcy plan in New Jersey late on Monday which outlines how the company intends to pay different types of cancer victims in the bankruptcy settlement. Will talc cause cancer. J&J has declared that its Talc products are safe, and will not cause cancer. Many states had initiated consumer protection cases against J&J prior to the time that LTL’s bankruptcy filing prevented those investigations from moving forward in 2021. Will talc cause cancer. New Mexico and Mississippi had already launched suits against Johnson & Johnson before then, and the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative demands or subpoenas, according to LTL’s court papers.

New Mexico and Mississippi have decided to declare LTL’s bankruptcy unfinished along with cancer sufferers as well as their counterparts from the U.S. Justice Department’s bankruptcy watchdog. argue that a profit-making business like J&J cannot benefit from bankruptcy protections intended for those struggling with debt.
LTL’s first attempt at resolving the bankruptcy cases was thrown out after similar arguments. In the end, a U.S. appellate court decided it was not LTL was not in “financial financial distress” and therefore not eligible to receive bankruptcy relief. Will talc cause cancer. LTL made a new bankruptcy application less than two hours after the dismissal, saying that the second bankruptcy was different because it had less money and had more support for a settlement.

New Mexico and Mississippi said in their motion for dismissal that LTL’s bankruptcy renewal violates state law enforcement powers by trying to unilaterally cap the liability of the company in state consumer protection laws.

The filings of LTL’s latest bankruptcy proceedings also include additional details about how the company would assess and pay for cancer claims should the bankruptcy plan be approved.

The maximum amount under the settlement would be $500,000 to those diagnosed with mesothelioma terminal prior to age 45, and $260,000 for those who have been diagnosed with terminal ovarian cancer before age 45.

The proposed settlement provides discounts based on the severity and type of the cancer, the person’s years of age, their history of using talc and other factors. Will talc cause cancer. For instance the case of a woman who used daily talc products, had a family history of ovarian cancer and was diagnosed with stage II ovarian cancer by age 55 may qualify to receive a payment of $21,125 under the plan.

Judge ordains J&J and talc opponents to take part in settlement talks.

Following another hearing in Johnson &Johnson’s attempt to utilize a Texas Two-Step bankruptcy strategy for talc litigation and federal bankruptcy judge Michael Kaplan has ordered the company and those opposed to the strategy to engage in negotiations to settle the matter, Bloomberg reports.

With its second bankruptcy attempt for LTL management, a subsidiary founded by J&J to settle claims – the company made a settlement offer of $8.9 billion. Will talc cause cancer. While a group of law firms representing plaintiffs support the proposal, another group opposes the deal.

Earlier this week, the opposition group, which is known as”the Official Committee of Talc Claimants, urged the bankruptcy court to disqualify the petition by saying that LTL can not be considered in financial distress.

“The filing is an incredibly legal and ineffective attempt by a handful of law firms to block claimants from voting on the resolution, which that the vast majority of claimants support,” J&J’s litigation chief Erik Haas, said in an announcement. Will talc cause cancer. “The law firms that are behind their filing are financially oriented and have conflicts that do not align with, diverge from, and contravene those which their clientele. We’ll be submitting an appeal to the appellate court.”

Will talc cause cancer. Clay Thompson, a lawyer for MRHFM that is home to more than mesothelioma victims who have sued J&J and J&J, has said that the company’s second bankruptcy try will fail.

“J&J publishes press release about how wonderful its plan is while simultaneously demanding that plan details–including what individuals with illnesses would receive,” Thompson said in the statement. “What do they have to cover up?”

Kaplan has instructed the sides to come up with another strategy for reorganization, under the oversight and supervision of mediators.

The court in February of 2022 Kaplan stated that J&J’s recourse to Chapter 11 to hasten a settlement that would release J&J from the hundreds of thousands of claims regarding its talcum products.

However, in the month of January, an appeals court of the federal government overturned the decision, deciding that the company was not able to be considered to be in “financial financial distress.”

In the event that J&J’s request to challenge the U.S. Supreme Court was dismissed the same month, J&J was granted a second petition for bankruptcy roughly two hours after. In response, Kaplan froze the lawsuits for 60 days to decide whether or not to approve an additional bankruptcy.

J&J’s unstoppable profit machine sputters after $6.9B settlement charge for talc.

With the 2 Chapter 11 attempts, J&J has bought 19 months during which cases were put on hold. Will talc cause cancer. The company is requesting that claimants decide whether they want to accept the settlement. J&J would need 75% support for the settlement to be approved.

In addition to the gang of talc lawyers who criticised the bankruptcy of the company, the U.S. Trustee, an arm from the U.S. Department of Justice was also the one to file a motion to dismiss LTL’s bankruptcy second case.

In a letter filed this week, U.S. trustee Andrew R. Vara wrote that the doors of bankruptcy are “open to honest but unfortunate debtors.” These doors “are not accessible to those that don’t have a legitimate bankruptcy goal or who seek to abuse the bankruptcy process to hinder or delay their creditors,” Vara continued.

On the other hand, J&J maintains there is no conclusive evidence that its Talc-based products, such as the famous baby powder, cause cancer. J&J has been taking the products of the market, first in North America in 2020–and the remainder of the globe later this year.

J&J wants to avoid the expense of going to court. The company has won most of the cases that were decided through trial, though certain losses have been harsh.
A highly-publicized trial in Missouri produced an $4.7 billion verdict against the drugmaker but was later reduced to $2.1 billion after appeals.

Overall, J&J has lost nine trial cases in talc which are in appeal or settled. Out of 41 trials 32 have ended in a win by J&J either through a mistrial or verdict of a plaintiff overturned in appeal. Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Will Talc Cause Cancer

June 2 2023 Update: In the asbestos talc case that took place in California yesterday, technical glitches interrupted the opening statements of the defense attorneys. Will talc cause cancer. Jurors watching from home via Zoom but did not hear Johnson and Johnson’s lawyer express skepticism about the 70s science claiming asbestos was present in their product prior to the trial was abruptly closed.

In the meantime, the plaintiff could introduce its first expert witness Arthur Langer. Langer said that the presence of other minerals with the talc’s mineral content is inevitable. He said that his team informed J&J in 1971 of the presence of chrysotile asbestos in the company’s talc, albeit at lesser than 0.1 percent. He also uncovered more asbestos in the year 1976.

June 1st, 2023 Update: Will talc cause cancer. The first trial since J&J has decided to separate its talc division, and then declare bankrupt is a pivotal moment for the ongoing lawsuit saga. The trial started yesterday in the tragic trial of a young plaintiff, diagnosed with a rare and aggressive form of mesothelioma in the past year, an illness that lawyers on both sides of the argument agree is a harrowing tragedy.

The opening statements exposed the distinct differences between each side’s narrative. The plaintiff’s attorney took aim towards Johnson & Johnson, alleging that the company employed deceitful methods in their research practices as well as throughout the litigation process. According to the attorney, the company attempted to manipulate asbestos’ definition, in spite of internal documents from 1978 and 1994 showing that asbestos fibers that were found in the plaintiff’s tissue are included.

Johnson & Johnson’s uncertain $8.9 billion settlement proposal hangs in the balance with the course of this trial. Despite the distinct nature of this mesothelioma lawsuit and its unique challenges compared to the majority of talcum powder lawsuits A verdict in favor of the plaintiff could be the company with a major setback in its hopes of broad acceptance of their settlement proposal among plaintiffs.

May 31st 2023 Update: Johnson & Johnson’s bankrupt talc division strongly defended its second Chapter 11 filing in the facing challenges from the talc injury plaintiffs. In an objection submitted to the New Jersey bankruptcy court, it argued that the case was vastly different from the prior filing. It highlighted the extraordinary commitment to $8.9 billion by J&J as the largest settlement ever made in any bankruptcy case that involves mass tort. Will talc cause cancer. Not mentioned: how the size of the settlement implies that it is an equitable settlement. J&J also claimed that it received support from numerous plaintiffs’ law companies representing over 60,000 claimants. This is not easy to confirm but it’s likely to be false.

May 24 2023 Update: As of Johnson and Johnson’s bankruptcy filing in 2021 filing, the first trial on its cosmetic talc items allegedly containing asbestos is set to start jury selection Monday in California within the Alameda County Superior Court, which is a well-known place for plaintiffs. The plaintiff claims that his mesothelioma was caused by asbestos exposure in J&J’s product which the company has denied. The trial also includes six retailers who are accused of selling talc-containing products.

May 22nd, 2023 Update: Lawyers in the 2nd J&J Talc bankruptcy are in a dispute over who should be chosen to fill the role of a future claims representative. This is a role that is critically critical to resolving Talc claims. Will talc cause cancer. Randi Ellis, a lawyer who is frequently involved in MDLs throughout the country was appointed the claims representative in the previous bankruptcy. J&J’s defense attorneys want Ellis to be appointed to this position in the future, however lawyers representing the plaintiffs in talc are arguing on the grounds that Ellis has an unrelated conflict of interest that should prevent her from taking on that role once more. The issue stems from the fact that Ellis was reportedly involved in drafting the hotly disputable second bankruptcy, raising doubts about her capability to remain neutral. The reality is this bankruptcy will likely to be dismissed regardless.

May 17, 2023 Update: The pretend company J&J put together for the talc litigation bankruptcy disclosed to an New Jersey bankruptcy court that they have designated $400 million to settle the claims made by states accusing J&J of misleading marketing for its talc products. Will talc cause cancer. That’s an $8.5 billion settlement for cancer victims. It’s difficult to envision an eventuality where J&J can push the baby powder settlements with these numbers. While J&J’s $8.5 billion offer may seem like a large sum initially, it does not appear appealing when you look at the numbers. This settlement proposal – by our rough calculations – would not provide victims with much more than an average settlement $100,000 per case. It’s not enough.

May 15, 2023 update: J&J might be facing lawsuit from an advocacy group that represents cancer victims. Will talc cause cancer. The group contends that J&J deliberately retracted an $61.5 billion financing agreement in conjunction with its affiliate, LTL Management LLC, to simulate financial stress and verify the unit’s Chapter 11 bankruptcy filing. The group claims that this move is a fraud transfer of the victims’ compensation rights. They will investigate J&J’s actions following of the decision to dismiss LTL’s first bankruptcy case.

May 10 2023 Update: Next week in the U.S. Bankruptcy Court in New Jersey will hear oral arguments in a motion reject the second bankruptcy filing that was filed by J&J company LTL Management. In the meantime, however this bankruptcy court has issued an order requiring both sides to participate in a new settlement negotiation hoping that an international settlement agreement can be reached.

May 5 2023 Update: Talc provider Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging its talc products caused cancer from asbestos exposure. Will talc cause cancer. Over 2,700 people have sued the company and the company was spending $1 million a month to defend its legal position. The company’s latest $29 million settlement that was handed down in South Carolina forced it to seek bankruptcy protection, arguing that assets should be distributed in an equitable manner to talc claimants, rather than being seized from the receiver. Other talc suppliers have also declared bankruptcy because of lawsuits.

May 4, 2023 Update: U.S. Court of Bankruptcy Michael Kaplan has directed Johnson & Johnson to restart negotiations with lawyers who rejected the company’s $8.9 billion settlement offer. In Trenton, New Jersey yesterday, the parties appeared in court to discuss next steps to take in another bankruptcy proceeding. Judge Kaplan was pushing for more settlement discussions.

This is the way to settle these claims with J&J. A settlement for baby powder can be achieved. Will talc cause cancer. But it will require more money – more billions of dollars – by Johnson & Johnson.

Lawyers are divided over whether to take the proposal or not and not all clients see the situation the same way their lawyer does. The second bankruptcy case is bound to fail as Judge Kaplan has scheduled a hearing in June to determine whether to discharge the bankruptcy for the 2nd time.

May 3, 2023 Update: A group representing cancer patients suing Johnson & Johnson (J&J) demanded that they request that the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it attempts to block litigation over talc products. The group of talc claimants has filed a motion this week asking for the Third Circuit to consider their case and to send it back to a lower court with instructions to dismiss the bankruptcy. Will talc cause cancer. The committee also requested that the halted tort litigation against J&J allow the litigation to proceed.
LTL applied for Chapter 11 protection once again following its bankruptcy filing that was rejected by the Third Circuit earlier this year, offering an $8.9 billion agreement. The committee believes that the recent decision allowing LTL’s second Chapter 11 to continue, as well as halting the trials against J&J, warrants an immediate Third Circuit review. The US Trustee requested it be requested that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s worldwide vice president of litigation, Erik Haas, was quoted by Bloomberg saying that J&J plans to file a statement in the appeals court, characterizing the filing as an “desperate and legally flawed attempt” by a small number of law firms that have conflicting financial interests.
May 1 2023 Update: A frequently asked question is how plaintiffs and their attorneys turn around $8.9 billion. Of course, that is an immense amount of money. There are a lot of victims. Will talc cause cancer. And these are really good claims for plaintiffs. We have been reminded of this recently by two talc-related trials that led to huge verdicts for the plaintiffs. In February, a talcum powder mesothelioma trial in Oregon ended in a verdict of $18.1 million. The following month, a second talc mesothelioma case went to trials within South Carolina and resulted in the verdict of $29 million in favor of plaintiff. The defendant in both cases was Whittaker, Clark & Daniels Inc. One of the top producers of talc in the U.S.
April 30, 2023 Update: When J&J first attempted to drag the litigation over talcum powder into bankruptcy, it came with an offer to set aside $2 billion to settle the case. This was an absurdly low amount. There was no one among the talc victims who believed in the proposal. This time, J&J has increased the offer to $8.9 if the talc plaintiffs are willing to accept bankruptcy settlements and they have the backing of a significant segment of the talc plaintiffs and their attorneys. Will talc cause cancer. But with 75% of plaintiffs who are a talc, which is required to approve bankruptcy plans is a difficult road since there are so many lawyers with vast inventory of baby powder litigations opposed in favor of the deal.

What are the solutions to the impasse? More billions.
April 25 2023, Update Talc cancer claimants have requested a judge to dismiss their Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, saying the company is not financially troubled. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders caused cancer. Will talc cause cancer. The 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company wasn’t eligible to receive bankruptcy relief because it had not demonstrated financial trouble.

The claimants argue that LTL’s third Chapter 11 case is an misuse of the bankruptcy system and that the case is being handled in bad good faith. J&J claims the bankruptcy settlement has “significant backing” from firms representing an estimated 60,000 people who are claiming. It is fair to say that the plaintiffs’ attorneys and victims are divided over what they believe is an $8.9 billion settlement offer.

April 21st, 2023 Update A bankruptcy judge decided that Johnson & Johnson must face new lawsuits claiming that the company sold baby powder that was contaminated and causing cancer. Although the trials for the talc lawsuits have been suspended for at least 60 calendar days however, new lawsuits may be filed, and lawyers will begin preparing their cases. Will talc cause cancer. Judges expressed skepticism about J&J’s ridiculous effort to revive its strategy with another bankruptcy case.

April 13th 2023 Update: major announcement is an $8.9 billion over the course of 25 year period settlement offered. Lawyers representing cancer patients who are part of the MDL group action pledged to fight the settlement alongside talc claimants. Why? They think it is not enough for 70 000 cancer patients. Will talc cause cancer. They argue that J&J should seek a bigger settlement or pursue individual claims if the most recent bankruptcy is declared unconstitutional.

However, there is a second group of lawyers outside of the leadership group in that class action. The lawyers collectively have accumulated tens of thousands of cases. The group is seeking to settle now in what many believe to be lower than what the victims should be paid. Their argument seems to be twofold. First, they argue that the settlement, which is about 100,000 dollars per plaintiff – is fair.

This is an argument that is difficult to prove. But their second argument has more substance: the victims will now not wait and they want to get their money right now.

April 12 2023 Update: People are seeking out how J&J is able to file for bankruptcy again. The answer is complex and convoluted. However, let’s attempt to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only option to resolve both current and future talc litigations in a definitive manner. It thinks it can get a lower rate in the event of a bankruptcy element that creates pressure to negotiate a settlement. Will talc cause cancer. Moving past more than 400 years in American time, the business claims that bankruptcy benefits all parties as it distributes settlement payments more evenly and effectively than trial courts, where litigants are awarded significant award while others do not.

The basic tenet of this 3rd Circuit decision was this is not a matter of the profit-making company that has an affiliate to accept the legal burden and declare bankruptcy – something Congress had in mind when it came to drafting the Bankruptcy Code. But it also said it was not financially crisis because J&J assured it of unlimited funding.
So J&J did not hesitate to take advantage of the unlimited funding portion of the contract but did not pledge that it would provide unlimited funds for litigation. The company claims that its revised financing arrangements with its subsidiary addresses the concerns of the appeals court while offering funds to pay claims. It’s as if giving victims less money will solve the overall issue.

Attorneys representing cancer victims who do not agree with the agreement counter this argument by saying that it is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s earlier decision. Hyperbole was not spared: victims’ lawyers call it the most significant “fraudulent transaction that has occurred in United States history.”

Despite the legal jargon, J&J does not really think this bankruptcy will survive. But it is a way of trying to push this $8.9 billion settlement to keep the pressure on plaintiffs.

April 10, 2023 update: Bloomberg is running an intriguing article on a new law that has been passed in New Jersey that is shedding new light on litigation funding in the class action lawsuit. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims in the case of Johnson & Johnson (J&J) on behalf of talc products. They exchanged in exchange for a portion of settlements. J&J is now offering to pay $8.9 billion to settle any lawsuits.

The funders’ involvement is made public because of the New Jersey court rule requiring the disclosure of certain information about funding sources outside of the. The rule aims to address the growing calls for regulation of the litigation funders. J&J has to deal with more than 60,000 lawsuits when you take into account federal and state baby powder lawsuits. Third-party funding in mass tort claims has both pros and pros and. There is no doubt that we are witnessing the ways that third-party funding can even the playing field for individuals as well as large corporations in court.

April 4 2023 Update: It’s interesting to watch the worm turn in this litigation. J&J suffered another setback this week when an appeals court in the Third Circuit denied J&J’s request to extend the automatic stay during the time that J&J appeals an appeal at the U.S. Supreme Court. Automatic stays have stopped thousands of talcum powder cases and stopped any the filing of new lawsuits ever since J&J started the controversial process to spin the talc liabilities into a bankrupt subsidiary more than one year back. Will talc cause cancer. When the 3rd Circuit ruled that this bankruptcy was not valid a few months ago, the stay was removed. J&J had hoped to have it continue in the meantime of hearing the SCOTUS appeal. The answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that of the Supreme Court is willing even to consider the appeal? Low.
March 16th, 2023 Update: with the bankruptcy stay being in effect, the first new cases have been filed and transferred into the Talcum Powder class action MDL in over one year. Seven new talc lawsuits were included in the MDL over the last month and brought the total number of pending cases up to 37,522.

February 25, 2023 Update 2023 Update: A Congressmen from Tennessee is now demanding that The U.S. Government Accountability Office (GAO) begin an investigation into the amount J&J product containing talc has cost the government over the decades.
A recent email addressed to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of ignoring the dangers of its talc-based products for many years, while tax dollars were spent on treating people who suffered injuries from exposure to the products. The lawsuit comes just a few weeks after J&J’s major loss in the 3rd Circuit Court of Appeals.

Will talc cause cancer. J&J has to begin making reasonable settlement offers for victims in order the process of putting all this behind. It’s a mark on one of the world’s greatest firms.

February 14 2023 Update: At an appearance today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the ruling of 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
